l8 Pursuant to this Conrt’s Order of September 26, 2006, Plaintiff, Northern Wisconsin I
19 Produce Company, Inc. ("Northern Wisconsin"), herewith submits its ninth report regarding
20 the status ofthe criminal action commenced by the United States against Steven Delaportas in Q
21 the United States District Court for the District of Arizona at Case No. 05-CR—1~ALL
22 ("Cri1ninai Action"). This civil action has been held in abeyance pending resolution ofthe
23 Criminal Action. Steven Delaportasf plea agreement with the United States has been approved
24 bythe Court. The sentencing hearing was continued from September 5 to November 6 and has
25 now been continued to March 12, 2007. This continuance is largely due to the fact that the
26 sentencing report had not yet been completed and will likely not be completed until the end of

i this year. Since the restitution amount to be awarded by the Court will be an important
2 element in Mr. Delapcrtas’ sentence in the Criminal Action, Northern Wisconsin maintains I
3 that this civil action shouid continue to be held in abeyance untii restitution has been
4 determined by the Court in the Criminal Action. .
5 WHEREFORE, it is respectfully requested that this Court continue to hold this civil
6 action in abeyance until a date subsequent tothe March 12, 2007 sentencing hearing inthe
7 Criminal Action. ___
