The court is in receipt of p1aintiff’s third status report filed
June 27, 2005 (Clerk's Docket No. 79). Plaintiff reports that criminal
proceedings against _defendant Steven. Delaportas will go to trial
September 7, 2005, and suggests a status conference in this case on or
after September 15, 2005.
If defendant Delaportas is acquitted at his September 7, 2005,
trial, then it would appear that a status conference on or soon after
September 15, 2005, will be appropriate. However, if defendant
Delaportas is convicted, the court wonders if it makes sense to conduct
a status conference in this case until sentence is imposed and judgment
entered in the criminal case. Plaintiff will please provide the court
with an updated status report on or before September 15, 2005.
