18 Pursuant to this Court’s Order of May 22, 2006, Plaintiff, Northern Wisconsin Produce
19 Company, Inc. ("Northern Wisconsin"), herewith submits its eighth report regarding the status
20 of the criminal action commenced bythe United States against Steven Delaportas inthe United
21 States District Court for the District of Arizona at Case No. 05~CR-l-ALL (“Cri1ninal
22 Action”). This civil action has been held in abeyance pending resolution of the Criminal
23 Action. In the Criminal Action, Mr. Delaportas entered into a plea agreement with the United
24 States. That plea agreement has been approved by the Court. The sentencing hearing was set
25 for September 5, 2006 but has now been moved to November 6, 2006. As earlier indicated to
26 this Court, restitution is an important component of the sentence in the Criminal Action. The

1 amount of restitution paid by Mr. Delaportas to Northern Wisconsin in connection with the
2 Criminal Action will directly impact on the damages suffered by Northern Wisconsin. 2
3 Northern Wisconsin, therefore, requests that this Court continue to hold this civil action in
4 abeyance and requests that this Court direct Northern Wisconsin to file its ninth status report
5 on or before November 30, 2006. 75
