18 Pursuant to this Court’s Order of July 7, 2005, Plaintiff, Northern Wisconsin Produce
19 Company, Inc. ("Northern Wisconsin"), herewith submits its report regarding the status of this
20 civil litigation. As this Court will recall, this civil action has been held in abeyance pending
21 resolution of a criminal action commenced by the United States against Steven Delaportas in
22 the United States District Court for the District of Arizona at Case No. 05-CR-1 ALL. In
23 Northern Wisconsin’s Third Status Report, the Court was informed that the criminal case
24 against Mr. Delaportas was scheduled for September 7, 2005. The trial on this criminal action
25 is now scheduled to commence on November 1, 2005. It is the undersigned’s belief that the

1 United States and Mr. Delaportas have been discussing various plea bargain prospects. To the
2 undersigned’s knowledge, no plea agreement has been reached in the criminal case.
3 Based on the foregoing, Northem Wisconsin requests that a status hearing be held by
4 this Court on the above-referenced civil case on or after December 15, 2005.
