18 Pursuant to this Court’s Order of March 23, 2006, Plaintiff, Northern Wisconsin
19 Produce Company, Inc. ("Northern Wisconsin"), herewith submits its report regarding the
20 status of the criminal action commenced by the United States against Steven Deiapoitas inthe
21 United States District Court for the District of Arizona at Case No. 05—CR—1·—ALL ("Crin1inal
22 Action"). This civil action has been held in abeyance pending resolution ofthe Criminai
23 Action. The trial inthe Criminal Action was set to commence on May 2, 2006. Just prior to
24 trial, Mr. Delaportas entered into a plea agreement with the United States. That plea agreement
25 has been approved by the Court, and sentencing is set for September 5, 2006. Since restitution
26 is an important component of the sentence in the Criminal Action and the amount of restitution

1 paid in connection with the Criminal Action will directly impact on the damages suffered by
2 Northern Wisconsin, Northern Wisconsin requests that this Court continue to hold this civil
3 action in abeyance. Northern Wisconsin further requests that this Court direct Northern
4 Wisconsin to file a status report on or before September 15, 2006.
