18 Pursuant to this Cou1·t’s Order of September 26, 2005, Plaintiff, Northem Wisconsin
19 Produce Company, Inc. ("Northern Wisconsin"), herewith submits its report regarding the
20 status of this civil litigation. Pursuant to this Court’s Order, this civil action has been held in
21 abeyance pending resolution of a criminal action commenced bythe United States against
22 Steven Delaportas in the United States District Court for the District of Arizona at Case No.
23 05-CR-1 ALL. In Northern Wisconsin’s Fourth Status Report, it was noted that the trial on
24 this criminal action was scheduled to commence on November l, 2005. Based on discussions
25 with Michelle Hamilton-Bums, attorney for the United States inthe Delaportas criminal

l matter, Northam Wisconsin understands the criminal trial is now set to begin on March 7,
