The defendant having appeared this date and having been provided with a summons to appear on 10/25/2005 at 2:00 p.m., before Judge Wake re: hearing on defendant's motion for mental competency, the warrants for defendant's arrest are quashed. Formal order to follow. IT IS ORDERED affirming the current release conditions, which include that the defendant maintain daily contact with his counsel and cooperate fully with trial preparations and further to remain in the District of Arizona. IT IS FURTHER ORDERED that prior to the 10/25/2005 hearing, the court reporter shall transcribe and transmit directly to Dr. Menendez those portions of defense counsel's comments in connection with the competency hearing of her dealings with the defendant as stated earlier and remarks of the Court as stated on the record this date, prior to the 10/25/2005 hearing. Defense counsel shall further directly transmit to Dr. Menendez any exhibits that were admitted at the 10/7/05 and 10/12/05 hearings along with any other historic documents of the prior "not guilty by reason of insanity" verdicts, prior to the 10/25/2005 hearing. IT IS FURTHER ORDERED that if the defendant is admitted to the Veteran's Administration Hospital, that he sign a medical release form and provide a copy to the Government. Total court time: 15 min.
