PRC, Paul K. Bryan, a.k.a. Lyle Edward Goeringer, d.b.a. Bryan Group International, Defendants. MOTION FOR HANDWRITING EXEMPLARS

The United States Government, by and through its attorney, the United States Attorney for the District of Arizona, herein respectfully request the Court order the defendants, Sharen Stewart and Paul Bryan, to submit to the taking of handwriting exemplars. At trial the government intends to introduce documents found during a search of defendant Stewart's home. The documents purportedly contain the handwriting of the

defendants. The government needs to obtain handwriting samples to determine whether or not the defendants authored portions of the documents. The defendants do not have a Fifth Amendment privilege to protect them from being required to furnish handwriting exemplars. United States v. Dionisio, 410 U.S. 1 (1973); Gilbert v. California, 388 U.S. 263, 265-67 (1967).

"Securing handwriting exemplars or handprinting from a defendant does not violate his right

2 against self-incrimination." United States v. Roth, 466 F.2d 1111, 1114 (9th Cir. 1972) 3 Based upon the foregoing, the United States requests the Court to issue an order directing

4 defendants Sharen Stewart and Paul Bryan to provide handwriting exemplars to federal law 5 enforcement agents designated by the government. 6 It is expected that excludable delay pursuant to 18 U.S.C. 3161(h)(1)(F) will occur as a
