The court has received a message from counsel for Defendant Paul K. Bryan that he will not appear for the status conference at 1:30 p.m. this day as ordered on October 7, 2005 (doc. # 157), having voluntarily admitted himself to the Veterans Administration hospital in Dallas, Texas. IT IS THEREFORE ORDERED that the order of October 7, 2005 (doc. # 157) is reaffirmed and that Defendant Paul K Bryan shall show cause at the October 12, 2005 hearing at 1:30 p.m. why a warrant should not be issued for his failure to appear at the status conference and the United Marshal ordered to arrest him and transport him forthwith to the District of Arizona to appear before this court. Defendant Paul K Bryan may present evidence by witnesses appearing by telephone if he wishes. IT IS FURTHER ORDERED that Defendant Paul K Bryan and his counsel shall arrange for Defendant Paul K Bryan's treating physician at the Veterans Administration hospital in Dallas, Dr. George Gurguis, to be available by telephone to testify at the October 12, 2005 hearing at 1:30 p.m. concerning the circumstances of Defendant Paul K Bryan's voluntary admission into the hospital, his medical condition, his ability to travel to the District of Arizona, Case 2:03-cr-01269-NVW Document 166 Filed 10/12/2005 Page 1 of 2

with or without the accompaniment of Deputy United States Marshals, and the capability, if any, of the Veterans Administration hospital in Dallas to conduct an evaluation of Defendant Paul K Bryan's mental competency to stand trial.
