Also present is attorney Patricia Gitre, CJA, counsel for defendant Stewart. Defendant Bryan's physician is not able to be present telephonically to testify. Defense counsel informs the Court that defendant is not able to be evaluated in the facility where he is currently located. Discussion is held regarding the trial. Trial is continued to October 26, 2005. Jury selection will proceed the first week, but the jury will not be sworn until 11/1/05. The Court orders that an arrest warrant be issued for defendant's failure to appear on 10/12/05 in violation of his release conditions, but that the US Marshal not execute the warrant until 12:00 p.m. on 10/17/05. If Defendant Bryan appears in this Court prior to 12:00 p.m. on 10/17/05, the Court will order the warrant quashed. Final pretrial conference set 10/14/05 is continued until Tuesday, October 25, 2005 at 2:00 p.m.
