1 The United States of America hereby notifies the Court that concurrently with this notice the

2 United States is lodging a proposed Partial Consent Decree, which has been fully signed by the
3 paries. If it is entered by the Court, the Partial Consent Decree will resolve the United States' claims

4 against the Defendant set forth in the United States' Complaint filed in case number CIV-04-1400-

5 PHX-ROS..
6 Pursuant to the terms of

Paragraph 136 ofthe Parial Consent Decree, and in accordance with

7 Section 122(d)(2) of

Comprehensive Environmental Response, Compensation and Liability Act, 42

8 U.S.c. § 9622(d)(2), and 28 C.F.R. § 50.7, the Partial Consent Decree will be available for public

9 comment for a period of not less than thirty days from the date on which the Federal Register
10 publishes notification of its lodging. After the close of the public comment period, the United States

11 will either file a motion requesting the Court to enter the Consent Decree, or the United States wil
12 inform the Court that it is exercising its right under Paragraph 136 of

the Parial Consent Decree to

13 withdraw its approval of

the Partial Consent Decree. Therefore, the United States requests that the

14 Court not take any action on the proposed Consent Decree at this time.
