17 Pursuant to the parties’ Sixth Supplemental Joint Case Management Report, the parties
18 submit the following Seventh Supplemental Joint Case Management Report And Request F or
19 Continuance Of April 14, 2006 Status Conference:
20 I. The Parties’ Activities Since March 16, 2006:
21 A. Contribution Claims: The parties’ direct negotiations havebeen P
22 successful with respect to the key monetary terms, and the parties will continue to pursue .
23 efforts to negotiate a Consent Decree comprehensively resolving the Contribution Claims. A
24 The parties presently anticipate that, within the next 60 days, they will reach a settlement-in-
25 principle (subject to approval by management for both parties).
26 B. Enforcement Claims: As noted in the Sixth Supplemental Joint Case
27 Management Report, the parties have reached agreement, subject to final approval by

l responsible United States officials, on a Consent Decree comprehensively resolving the
2 Enforcement Claims, which the parties hope to lodge with the Court shortly.
3 II. Continuance of April 14, 2006 Status Conference: Given the significant
4 progress that has been made toward achieving a settlement of both consolidated matters, the
5 parties wish to forego active litigation and believe that entry of a Rule 16 scheduling order is
6 not presently needed. In order to conserve resources and focus efforts on continuing to
7 negotiate a consensual settlement of the Contribution Claims, the parties respectfully request
8 that the Court continue the status conference presently scheduled for April 14, 2006. Should
9 there be additional relevant developments with respect to this matter, the parties will advise Z
10 the Court promptly. J
