17 Pursuant to the parties’ Fourth Supplemental Joint Case Management Report, the
18 parties submit the following Fifth Supplemental Joint Case Management Report:
19 I. The Parties’ Activities Since January 13, 2006: 7
20 A. Contribution Claims: The parties conducted a mediation session
21 before mediator John Bickerman on January 24. Although they did not reach a settlement,
22 they narrowed their differences, and negotiations continue, facilitated by Mr. Biclcerman.
23 B. Enforcement Claims: Following continued discussions, and subject to
24 approval by management for both parties, the parties believe that they are close to tinalizing a
25 comprehensive settlement of the Enforcement Claims and an accompanying Consent Decree.
_ 26 H. Further Steps to Facilitate Settlement: The parties propose that the Court
27 allow an additional period of 30 days for further efforts at reaching a settlement of the
28 Contribution Claims, and to permit a tinal resolution ofthe Enforcement Claims. The parties

l propose to provide a joint status report to the Court by March 16, 2006, summarizing the
2 status of these efforts. i
3 III. The Scope and Scheduling of Discovery: The parties propose that active
4 litigation remain in abeyance through mid-March 2006, and thus believe that entry of a Rule
5 16 scheduling order is not presently needed. Should the parties reach an impasse, such that
6 the matter should proceed (in whole or in part) into active litigation, the parties will advise
7 the Court promptly.
