19 Pursuant to the pa1·ties’ Third Supplemental Joint Case Management Report, Crane Co.
2() ("Crane"), Unidynamics/Phoenix, Inc. ("UPI"), and the United States of America, on its own
2] behalf and on behalf of all other parties to this consolidated action (collectively, the "United A
22 States"), submit the following Fourth Supplemental Joint Case Management Report:

24 I. The Parties’ Activities Since December 15, 2005:
25 A. Contribution Claims: The parties conducted a mediation session
26 before mediator John Bickerman on December l6, to discuss liability and allocation
27 questions and to attempt to reach a negotiated resolution of UPI’s and Crane’s claims.
28 Although the parties did not reach a settlement of the Contribution Claims, they gained an

I enhanced understanding of each other’s factual and legal positions, and have scheduled an A
2 additional mediation session for January 24. As agreed at the mediation, UPI and Crane are
3 sending a revised settlement demand to the United States to serve as a basis for further
4 discussions. A
5 B. Enforcement Claims: The parties have continued discussions directed
6 toward finalizing a comprehensive settlement of the Enforcement Claims and an it
7 accompanying Consent Decree. The parties have further reduced the number of unresolved
8 issues and, subject to approval by management for both parties, believe that they are close to
9 reaching a final agreement. *

11 II. Further Steps to Facilitate Settlement: The parties propose that the Court 2
12 allow an additional period of 30 days for further efforts at reaching a consensual resolution of
13 the Contribution Claims, and to permit the final resolution of outstanding issues with respect A
14 to the Enforcement Claims. The parties propose to provide a joint status report to the Court
15 by February 16, 2006, summarizing the status of these efforts.

17 III. The Scope and Scheduling of Discovery: The parties continue to propose that i
18 active litigation remain in abeyance at least through mid-February 2006, and thus that entry
19 of a Rule 16 scheduling order is not presently needed. Should the parties reach an impasse,
20 such that the matter should proceed (in whole or in part) into active litigation, the parties will
21 advise the Court promptly. Y
