17 Pursuant to the parties’ Fifth Supplemental Joint Case Management Report, the parties
18 submit the following Sixth Supplemental Joint Case Management Report:
19 I. The Parties’ Activities Since February 16, 2006:
20 A. Contribution Claims: The parties have continued direct negotiations,
21 have narrowed their differences considerably, and continue to pursue efforts to reach a
22 consensual resolution of the Contribution Claims. The parties anticipate that, within the next
23 30 days, they will reach either a settlement-in-principle (subject to approval by management
24 for both parties), or an impasse (such that the case should proceed into active litigation).
25 B. Enforcement Claims: The parties have reached agreement, subject to
26 final approval by responsible United States officials, on a Consent Decree comprehensively
27 resolving the Enforcement Claims, which the parties hope to lodge with the Court shortly.

1 Il. Further Steps to Facilitate Settlement: The parties propose that they forego
2 active litigation until the scheduled April 14, 2006 status conference, and thus believe that
3 entry of a Rule 16 scheduling order is not presently needed. Should there be additional
4 relevant developments with respect to this matter, the parties will advise the Court promptly.
5 lf necessary, the parties will provide the Court with their proposals regarding any Rule 16
6 scheduling order by April 7, 2006.
