21 Kenyon has provided written consent to the substitution. Mr. Kenyon’s decision to retain
22 new counsel is the reason for this Application. As allowed by Rule 83.3(b), this Application
23 is presented to the Court on an ex parte basis for immediate entry, counsel for all patties will
24 be given notice of this Application once the Order, a proposed form of which is being lodged
25 herewith, is entered. After the Order has been entered, defendant William A. Kenyon can be
26 contacted through Mr. Grimsley and/or Mr. Maskovich.
