The plaintiff, Securities and Exchange Commission ("Commission"), and defendant,

19 Grant D. Seeger ("Seeger"), through their respective counsel, hereby move the Court for a 20 further extension of the briefing schedule with respect to the Commission's pending motion 21 for summary judgment ("Motion"). 22 As the parties informed the Court on October 4, 2007, counsel have negotiated a

23 settlement. Seeger has executed and delivered to the Commission the consent to entry of 24 judgment that memorializes the terms of that settlement. The settlement is currently

25 awaiting Commission approval. Further briefing on the Motion will be necessary only if the 26 Commission rejected the settlement. 27 The parties therefore move the Court to enter an order that: (i) extends Seeger's time

28 to serve and file any response to the Motion until 10 days after the Commission files a notice

1 that it has rejected the proposed settlement; and (ii) provides that the Commission shall have 2 14 days after service of a response within which to serve and file any reply memorandum in 3 support of the Motion. 4 5 A proposed form of Order accompanies this motion.
