Plaintiff, Securities and Exchange Commission ("Commission"), and defendant,

19 Grant D. Seeger ("Seeger"), through undersigned counsel, hereby jointly move this Court: 20 (i) to vacate the Court's October 2, 2007 Order granting the Commission's motion for 21 summary judgment (docket no. 112); and (ii) to adopt a briefing scheduling for the motion 22 granting Seeger until December 7, 2007 to file any opposition and the Commission until 23 December 21, 2007 to file any reply. 24 Prior to issuance of the Court's October 2, 2007 Order (that same morning in fact),

25 counsel for the parties had reached an agreement on a briefing schedule for plaintiff's motion 26 and a tentative agreement on the terms of a settlement, which must be presented to the 27 Commission for its approval. The relief requested in this joint motion is sought to provide 28 an opportunity for the Commission to consider the tentative settlement.
