1 DECLARATION OF JUDE P. DAMASCO IN SUPPORT OF FEE REQUEST

3 I, Jude P. Damasco, am over eighteen years of age and state the following facts which I
4 know of my own personal knowledge. A
5 1. I am the managing partner of Damasco & Associates LLP ("Damasco"), located at 700
6 Monte Vista Lane, Half Moon Bay, CA 94019. I am a certified public accountant.
7 2. Damasco was appointed as Tax Administrator for the SEC v Security Trust Company
8 Distribution Fund in the Order Granting Plaintiff Securities and Exchange Commission's
9 Motion for Appointment of a Tax Administrator, Case No. CV-03-2323-PHX-JWS filed on
10 December 16, 2005.
11 3. Pursuant to our engagement agreement with the SEC, attached is a true and correct 1
12 copy of our invoice for preparation and filing of the tax years 2004 and 2005 qualified
13 settlement ftmd penalty abatement and related tax compliance services for the SEC v Security
14 Trust Company Distribution Fund. 1 ·
-15 4. On Jtme 12, 2006, DEIITIESCO received a check for the amount of $13,589 from the SEC
16 v Security Trust Company Distribution Fund for the purpose of paying 2004, 2005, and 2006 ‘
17 tax year liabilities. As a result of successful penalty abatements for the tax years 2004 and
18 2005, la remainder of $1,421.15 remains from the $13,589. Damasco has since been holding -
19 these funds in the Damasco SEC Client Trust account.
20 5. Additionally, on April 5, 2007, Damasco received a check for the amount of $670 from
21 the Internal Revenue Service for a 2006 tax year overpayment Damasco made on behalf of the
22 SEC v Security Trust Company Distribution Fund, which resulted in a refund. Damasco has
23 since been holding these funds in the Damasco SEC Client Trust account as well.
24 6. Please grant Damasco authority to remit payment to Damasco for the attached
25 outstanding invoice of Damasco in the amount of $1,528.45 from the $2,091.15 that Damasco l

I is currently holding the`Damasc0 SEC Client Trust account. The remaining $562.70 will be
2 returned to the United States Treasury as directed by the Court.
