Pursuant to joint motion of the parties, the Court having been apprised that a tentative,

15 negotiated settlement of this matter has been presented to the Securities and Exchange 16 Commission for its consideration, and good cause appearing, 17 18 IT IS HEREBY ORDERED that: 1. Defendant Grant D. Seeger shall serve and file any memorandum in opposition

19 to plaintiff's motion for summary judgment within ten days after plaintiff files a notice that 20 the Securities and Exchange Commission has rejected the tentative settlement of this matter; 21 and 22 2. Plaintiff shall have fourteen days following the service of a memorandum in

23 opposition within which to serve and file any reply memorandum in support of its motion for 24 summary judgment. 25 26 27 28
