The Court has been advised that this case has settled as to remaining defendants, Brunch and Tate. (Doc. #54). IT IS THEREFORE ORDERED that this matter will be dismissed without prejudice on or after November 14, 2005, unless prior thereto a request for reinstatement on the court's trial calendar is filed herein. IT IS FURTHER ORDERED all pending motions are denied without prejudice with leave to reinstate should the parties fail to finalize the settlement agreement. IT IS FURTHER ORDERED vacating all pending deadlines and the final pretrial conference set December 2, 2005. DATED this 12th day of October, 2005.
