20 counsel, hereby give Notice to the Court that the Parties reached a settlement
21 agreement in this case on October 11, 2005. Defendants’ counsel mailed today
22 a Release and Indemnity Agreement to Plaintiff. Upon receipt of a fully

1 executed copy of the Release, Defendants will send to Plaintiff a settlement
2 check; and afterwards will tile with the Court a fully executed Stipulation to
3 Dismiss.
