As reflected in previous filings, the parties have reached agreement on a partial settlement resolving several issues in this case. They have executed a Term Sheet reflecting the agreed-upon terms. Since execution of the Term Sheet, they have been drafting the detailed terms of the settlement agreement and related documents, including documents to provide notice and a claims process for members of the class. Based on earlier estimates provided by counsel, the Court previously set September 21, 2007, as the date for filing both an application for preliminary approval of the partial settlement and a joint proposed Scheduling Order addressing the remaining issues in this case. (See Dkts. 303 and 304.) The Court scheduled a hearing for September 28, 2007, to address these filings. Because completion of the complex settlement documents has taken longer than anticipated, the parties jointly request that the Court reset the September 21 filing date and the September 28 hearing date. The parties believe that they will be prepared to file no later than October 12, 2007, the application for preliminary approval of the partial settlement and a joint proposed Scheduling Order. They therefore stipulate and request that the Court enter their proposed order resetting October 12, 2007, as the date for filing these papers and rescheduling the hearing to a date approximately one week later, at the Court's convenience.
