On April 16, 2007, following submission by the parties of a joint motion, the Court issued its Fourth Revised Rule 16 Scheduling Order (the "Rule 16 Order") (Dkt. 291). Since then, the parties have continued to engage in significant mediation efforts. As described previously (see Dkt. 292), the parties jointly retained two mediators, one with expertise in litigation mediation and the other with specialized expertise in ERISA matters. After many joint and separate mediation sessions, as well as phone calls and written communications, the parties have made good progress. Further mediation efforts remain. The parties expect to know on or before June 30, 2007, whether a settlement agreement has been reached. To allow the parties and their counsel to participate meaningfully in the mediation effort, they have been required to postpone discovery that otherwise would be necessary to meet the various deadlines set forth in the Rule 16 Order. For these reasons, the parties request that the Court vacate the dates established in the Rule 16 Order and require that the parties submit, on or before June 30, 2007, either a notice of settlement or a report on the status of settlement discussions. If no settlement agreement has been reached, the parties propose that within 10 days after submitting their status report they would submit a new proposed Rule 16 scheduling order, with revised dates.
