M Pursuant to the Court’s January 3, 2006 Order, the Parties respectfully submit
15 Final Status Report to the Court and this Stipulation ot`Dismissal.
16 The Status Report relates to the settlement in a related class action in the Southeri
17 District of New York, entitled In re American Express Financial Advisors. Case No. 04-
IS cv—l773 (DAB) (°“New York action"), and its impact on the instant action. On July 18,
19 2007, an Order was issued in the New York action granting final approval of th
20 settlement. The Judgment in the New York action fully resolved all claims in the Harito
21 action. The appeals period on that Judgment has now expired and the settlement — value
22 at more than $100 million — will now proceed, providing benetits to Plaintiffs in th
23 Haritos action.
24 Accordingly, pursuant to Fed. R. Civ. P. 41(a)(l)(A)(ii), the Parties hereby tile
25 Stipulation of Dismissal with Prejudice for the instant action, with costs to the Parties.
26 The Parties respecttully request the Court to enter an Order dismissing the actioi
27 (Proposed Order attached as Exhibit A).
