The parties having stipulated to the stay of this action pending the approval of the proposed settlement in a related putative class action, In re AEFA Securities Litigation, 04-CV-1773, currently pending in the United States District Court for the Southern District of New York, IT IS ORDERED that the defendant's Motion for Stay of Proceedings (doc. #163) is deemed withdrawn. IT IS FURTHER ORDERED that the parties' Stipulation to Stay of Proceedings (doc. #176) is accepted to the extent that this action is stayed pending further order of the Court. IT IS FURTHER ORDERED that the defendant shall promptly notify the Court of the ruling of the United States District Court for the Southern District of New York concerning the proposed settlement in In re AEFA Securities Litigation, 04-CV-1773 (S.D.N.Y.). The notification shall be made through the filing of a Notice of Ruling.

IT IS FURTHER ORDERED that the parties shall file a joint status report no later than February 28, 2005 if no ruling has been made by that date concerning the proposed settlement in In re AEFA Securities Litigation, 04-CV-1773 (S.D.N.Y.). IT IS FURTHER ORDERED that the parties shall file a joint status report no later than fifteen (15) days after the ruling on the proposed settlement in In re AEFA Securities Litigation, 04-CV-1773 (S.D.N.Y.) that sets forth the impact of that ruling on this action.
