15 Pursuant to the Court’s January 3, 2006 Order and the Parties’ February 21, 2007
16 Joint Status Repoit, the Parties respectfully submit this Joint Status Report to update th
17 Court on the status of the settlement in a related class action in the Southern District o
18 New York, entitled In Re Aznericon Express F incznciol Advisors, Case No. 04-CV~l773
19 (DAB) ("In re AEFA action"), and its impact on the instant action.
20 The Final Approval Hearing in that matter took place on July 13, 2007. On July
21 18, 2007, the Court issued an Order granting final approval of the settlement; Defendan
22 tiled a copy of that Final Approval Order with this Court on July 23, 2007. Th
23 Judgment in the In re AEFA action will fully resolve all claims in the Haritos action.

Accordingly, after the expiration of the appeals period for the Final Approval

Order, Plaintiffs’ Counsel will tile with the Court a Notice of Dismissal with Prejudic
