13 JOINT STATUS REPORT: NOTICE OF RULING
14 Pursuant to the Court’s January 3, 2006 Order, the Parties respectfully submit this
15 Joint Status Report to update the Court on the proposed settlement in a related class
16 action in the Southern District of New York, entitled In Re American Express F tnoncio
17 Advisors, Case No. 04-CV-1773 (DAB) ("1n re AEFA action").

On February 14, 2007, the Southern District of New York Court issued an Orde
19
granting preliminary approval of settlement in the In re AEFA action. The Parties in th
20
instant action ("Horitos action") are providing a copy of this Order, attached as Exhibi
21
A.

23 For the Court’s information, the Final Approval Hearing for the In re AEFA actio
24 will be held on June 4, 2007. When a Final Approval Order is issued, the Parties in th
25 Horttos action will also provide the Court with a copy of that Order.
26 Finally, after the expiration of the appeals period for the Final Approval Order,
27 assuming the filing of such Order, Class Counsel will file a Notice of Dismissal for th
28 Horitos action with the Court.
