Pursuant to Rule 54.2(b)(1) of the Local Rules of Civil Practice of the United States District Court for the District of Arizona, Defendant Avent Inc. hereby moves for an award of its attorneys' fees and related non-taxable expenses incurred in the successful defense of this action. The Clerk entered it's the Judgment dismissing the Plaintiff's claims on February 6, 2006. The statutory authority entitling Defendant Avent to an award of its reasonable attorneys' fees is 35 U.S.C. § 285. See Interstate Forging Indus. v. Federal Forge, Inc., 1999 U.S. Dist. LEXIS 8760 at *7-*8 (W.D. Mich. June 8, 1999). A good-faith estimate of the amount of fees and non-taxable expenses current sought by Defendant Avent is $7,500.00. If the parties are unable to resolve any disputes over Defendant Avent's fee claim in accordance with the consultation process specified in L.R. Civ. 54.2(d)(1), Defendant Avent reserves its right to seek recovery of the additional attorneys' fees and non-taxable expenses it may reasonable incur in preparing the supporting memorandum and document described in L.R. Civ. 54.2(b)(2)-(3) and (c)-(d),
