Pursuant to 35 U.S.C. § 285 and Local Rule 54.2(b)(1), defendant, Nash Finch Company ("Nash Finch") hereby files its Motion for an Award of Attorney's Fees and Non-Taxable Costs. Plaintiff initiated this action on April 14, 2000. Defendant Nash Finch filed its Answer on October 2, 2000. By this Court's Order of April 3, 2001, this action was stayed pending a final non-appealable judgment in Symbol Technologies, Inc. v. Lemelson Medical, Education & Research Foundation, Limited Partnership, then pending in the U.S. District Court for the District of Nevada.

On November 16, 2005, the U.S. Court of Appeals for the Federal Circuit held that all of the claims of the patents in suit are unenforceable. On December 22, 2005, Plaintiff filed a Motion to Dismiss this case in its entirety, with prejudice, in view of the Federal Circuit's determination that all claims of the patents in suit are unenforceable. On February 6, 2006, Judgment was entered dismissing this action in its entirety including all claims and counterclaims, with prejudice. Pursuant to 35 U.S.C. § 285 this Court is authorized to award reasonable attorneys' fees to the prevailing party. As a result of the Court's February 6, 2006 dismissal with prejudice, Nash Finch is a prevailing party in this proceeding. Nash Finch believes that a fair estimate of the amount of attorney's fees that will be requested is $14,000 and that a fair estimate of the related non-taxable expenses that will be requested is $400.00. As set forth in Local Rule 54.2(b)(1), this Motion specifies (a) the applicable judgment and the statutory authority entitling Nash Finch to the award; and (b) a fair estimate of the amount of attorney's fees and related non-taxable expenses being sought.
