award of its reasonable attorneys' fees is 35 U.S.C. § 285. See Interstate Forging Indus. v. Federal Forge, Inc., 1999 U.S. Dist. LEXIS 8760 at *7-*8 (W.D. Mich. June 8, 1999). In preparing its infringement claim against Systemax and the other defendants, particularly after the real parties in interest had brought suit in another jurisdiction, plaintiff engaged in conduct that was unfair, in bad faith, inequitable, unconscionable, vexatious and reckless, making this an exceptional proceeding within the meaning of 35 U.S.C. § 285. As a result of plaintiff's improper litigation tactics, Systemax incurred significant litigation fees and related non-taxable expenses. A good faith estimate of the amount of fees and non-taxable expenses currently sought by Systemax, which includes fees for time spent on a non-infringement opinion as well as in defending this action, is $135,000.00. If the parties are unable to resolve any disputes over Systemax' fee claim in accordance with the consultation process specified in LRCiv 54.2(d)(1), Systemax reserves its right to seek recovery of the additional attorneys' fees and non-taxable expenses it may reasonably incur in preparing the supporting memoranda and documentation described in LRCiv 54.(b)(2)-(3) and (c)-(d), and in otherwise prosecuting its fee request to a final determination by the Court. See Mathis v. Spears, 857 F.2d 749,756 (Fed. Cir. 1998); In re Nucorp Energy, Inc., 764 F.2d 655, 659-60 (9th Cir. 1985) ("In statutory fee cases, federal courts, including our own, have uniformly held that time spent in establishing the entitlement to and amount of the fee is compensable.")
