No defendant has opposed Lemelson's motion to dismiss with prejudice, and some have joined or supported it. Several defendants (Ingram, Nash-Finch, Musicland, Best Buy, and Target) requested that the Court include Rule 54(b) language in the order of dismissal, but that appears unnecessary because all claims of all parties appear ready for dismissal. Claiborne has urged the Court to condition dismissal "upon Claiborne's right to seek an award of its reasonable attorneys' fees pursuant to 35 U.S.C. § 285 and in accordance with Rule 54.2 of this Court's Local Rules ...." Such a condition is unnecessary as well, because Claiborne has the right to seek fees

under the cited rules (and Lemelson can oppose it if it does). Systemax joined Claiborne's request. In addition, Systemax moved for attorneys' fees. Lemelson's response to that motion is filed separately. Jo-Ann Stores has consented to dismissal of its Counterclaim, but asked that it be without prejudice, and Lemelson has no objection to that request. Accordingly, Lemelson respectfully requests that the Court grant the motion and dismiss all claims of all parties with prejudice, with the exception that Jo-Ann Stores' counterclaim should be dismissed without prejudice.
