As stated in Systemax' (1) joinder in Defendant Liz Claiborne, Inc.'s crossmotion to add condition upon dismissal and (2) motion for attorneys' fees pursuant to Fed. R. Civ. P. 41(a)(2) (the "Moving Papers"), there exists overwhelming support for awarding Systemax its attorneys' fees and costs in this action for the reasons set forth in the Moving Papers. While Systemax does not contest Plaintiff's dismissal with prejudice pursuant to Fed. R. Civ. P. 41(a)(1)(i), Systemax incorporates by reference its request for attorneys' fees pursuant to 35 U.S.C. § 285 as set forth in the Moving Papers and in accordance with Fed. R. Civ. P. 54 and Local Rule 54.2.
