Pursuant to Rule 54.2(b)(1) of the Local Rules of Civil Practice of the United States

25 District Court for the District of Arizona, Defendant Liz Claiborne, Inc. ("Claiborne") 26 hereby moves for an award of its attorneys' fees and related non-taxable expenses incurred 27 in the successful defense of this action. The Court entered its signed Judgment dismissing 28 the Plaintiff's Third Amended Complaint on February 6, 2006. The statutory authority

1 entitling Claiborne to an award of its reasonable attorneys' fees is 35 U.S.C. § 285. See 2 Interstate Forging Indus. v. Federal Forge, Inc., 1999 U.S. Dist. LEXIS 8760, at *7-*8 3 (W.D. Mich. June 8, 1999). 4 A good faith estimate of the amount of fees and non-taxable expenses currently

5 sought by Claiborne is $29,000. If the parties are unable to resolve any disputes over 6 Claiborne's fee claim in accordance with the consultation process specified in LRCiv 7 54.2(d)(1), however, Claiborne reserves its right to seek recovery of the additional 8 attorneys' fees and non-taxable expenses it may reasonably incur in preparing the 9 supporting memoranda and documentation described in LRCiv 54.2(b)(2)-(3) and (c)-(d), 10 and in otherwise prosecuting its fee request to a final determination by the Court. See In re 11 Nucorp Energy, Inc., 764 F.2d 655, 659-60 (9th Cir. 1985) ("In statutory fee cases, federal
