Before the Court is the Agreed Motion to Dismiss With Prejudice, filed on September 27, 2005 by Plaintiff/Counterdefendant Aventis Technologies Corporation and Defendant/Counterclaimant Barons Financial Group, Inc. and Defendant Dan D. Wolfe. The Court, having reviewed the pleadings in this matter, and being advised that Plaintiff Aventis Technologies Corporation and Defendants have reached a compromise agreement and settlement of their dispute with prejudice and with each party to bear its own attorneys' fees and costs, finds that the Agreed Motion to Dismiss With Prejudice is well taken and should be granted. Therefore, IT IS ORDERED that the claims by Plaintiff Aventis Technologies Corporation against Defendants Barons Financial Group, Inc. and Dan D. Wolfe and the claims by Counterclaimant Barons Financial Group, Inc. against Counterdefendant Aventis Technologies Corporation are hereby dismissed with prejudice, with each party to bear its own attorneys' fees and costs. (Granting Doc. #113 and denying Doc. #112 as moot.) IT IS FURTHER ORDERED that because this Order includes all the claims between the only remaining parties, the Clerk of the Court shall terminate this action. DATED: October 11, 2005.
