Jury Verdict. This action came before the Court for a trial by jury. The issues have been tried and the jury has rendered its verdict. XXX Decision by Court. This action came for consideration before the Court. The issues have been considered and a decision has been rendered. IT IS ORDERED AND ADJUDGED that this Court has granted Defendants' Motion for Summary Judgment with respect to Plaintiff's claims under 42 U.S.C.A. 1983 against Defendant Officer Sund and the city of Mesa. The Court declines to exercise jurisdiction and reach the merits of Plaintiff's state law claims of assault and battery and malicious prosecution. Those claims are dismissed without prejudice. THEREFORE IT IS FURTHER ORDERED AND ADJUDGED that Plaintiff take nothing. The Complaint and this action are hereby dismissed.
