U " I2 Judgment and urge this Court to deny same, because this ease involves multiple
IS Defendants with common facts, arguments and defenses that remain to he

20 It is well-settled law that when there are multiple Defendants in a case
2I which are alleged to be jointly liable and one of them defaults, a default judgment I "
22 should not be entered against the defaulting defendant until the matter has been ;
23 adjudicated with regard to all defendants. See F trst TID. & Investment, Inc. v.
24 Chang, 253 F.3Cl 520, 532 (9m Cir. 2001); Frow v. De Lo Vega, 82 U.S. 552
25 (1872). "This policy avoids the possible absurdity of the Court sustaining a charge _
26 against a defaulting party but later dismissing that charge as unfounded? See

3 ln this case, Fletcher timely Answered and opposed Plaintiffs Complaint,
4 which makes allegations that Fletcher conspired with Defendant Glenn F. Kelly to
5 breach a fiduciary duty, and that Defendants are jointly liable for all alleged
6 damages. lt would be inappropriate to enter a Default Judgment for an 1
7 unsubstantiated amount of unliquidated damages against Defendant Glenn F.
8 Kelley, when Fletcher has not had the opportunity to adjudicate the merit of E
9 Plaintiffs claims, which very likely could lead to an incongruous result. See First
10 TD. & Investment, hir:. (supra). =
