U r` 17 correct the Docket and Record herein with respect to the jurisdictional basis for Q
18 this action because this case is currently classified as and appears to be treated as a
19 "Prisoner Civil Rights” action under 42 U.S.C. § 1983, when in fact this case is
I 20 simply a civil dispute based on diversity jurisdiction pursuant to 28 U.S.C. § 1332. I
21 It is true that Plaintiff is an incarcerated prisoner in the State of Texas and 1
22 tiled this action pm se; however, this case was filed in Federal Court in the
23 District of Arizona on the basis of Diversity Jurisdiction, such that there is ne
24 "federal question" involved. A review of Plaintiff s Complaint at page one,
25 paragraph one clearly states that "}urisdiction is properly invoked by the Plaintiff
26 pursuant to the U.S. Constitution Article III, § 2, and 28 U.S.C. § 1332(a)." Q

1 Fletcher does not dispute that the parties herein are "diverse," and has admitted
2 that Diversity Jurisdiction and Venue in this Court are proper.
3 It should also be noted that the substantive basis for Plaintiff` s claims are

4 not based on any Federal law or statute. As such, Arizona substantive law should J -
5 apply in analyzing Plaintifi" s alleged causes of action, which are "breach of _ .

6 fiduciary duty”’ and "conspiracy to breach tlduciary duty." I
7 WHEREFORE, in light ofthe foregoing, Fletcher respectfully requests the
8 Court to correct the docket and record in this action to reflect that the true
9 jurisdictional basis for Plaintiff s claims is Diversity Jurisdiction, such that
EO Plaintiff` s claims and all substantive questions herein will be analyzed under
