ORDER

The Court is in receipt of Defendant Glenn Kelley's "Motion to Continue" (Doc.

# 35). The Court will construe the motion as a motion for extension of time to file an

answer in this case. To that extent, Defendant's motion will be granted. Defendant
18

Kelley shall have until December 2, 2005 to file his answer.

Defendant Kelley also requests financial assistance in serving the plaintiff and
20

filing with the court. This request will be denied. Accordingly,
21

IT IS ORDERED that Defendant's Motion to Continue, construed as a motion for
22

extension of time to file an answer (Doc. # 35) is GRANTED. Defendant Kelley shall
23

file his answer by December 2, 2005.

IT IS FURTHER ORDERED that Defendant's request for financial assistance is
25

DENIED.
