17 Pending before the court is a motion for court assistance filed by the plaintiff on April
18 28, 2005. [#l6]' The court has received no response.
19 On April 1, 2004, the plaintiff, Acton, commenced the instant action. His second
20 amended complaint was tiled on March 23, 2005. On the same day, the court ordered service
21 on defendants Robert Jones, Doctor Sheetz, Dennis Chenail, Karen Neubauer, Susan
22 Buffington, Dora B. Schriro, Nurse Nicks and Terry L. Stewart.
LO} [ 23 Service on defendants Jones, Neubauer, Nicks, and Sheets (the Missing Defendants)
5qh+ 24 was unsuccessful. Acton moves that this court assist him in serving these defendants. Good

l IT IS FURTHER ORDERED that:
2 (1) The Clerk of the Court shall transmit a copy of this order to the Arizona
3 Department of Corrections and to the Office ofthe Arizona Attorney General. On or before
4 July 9, 2005, the Arizona Department of Corrections shall file with the court, a current work
5 address for the Missing Defendants if they are still employed by the Arizona Department of
6 Corrections, or if not so employed, under seal the last known home address of the Missing
7 Defendants. I
8 (2) The United States Marshal shall again attempt waiver of service or service of
9 process in accordance with the court's previous service order.
10 This order supercedes the court’s order of May 31, 2005, which was issued before
ll the defendants, Schriro, Buffington, and Stewart, made their appearance.
