IN THE UNITED STATES DISTRICT COURT FOR THE DISTRICT OF COLORADO Judge Robert E. Blackburn Civil Case No. 04-CV-00781-REB-PAC (Consolidated with Civil Action 06-CV-02189) SHRINERS HOSPITALS FOR CHILDREN, a Colorado Corporation, Plaintiff, v. QWEST COMMUNICATIONS INTERNATIONAL INC., et al., Defendants.

QWEST'S UNOPPOSED MOTION FOR LEAVE TO EXCEED PAGE LIMIT FOR MOTION OF QWEST COMMUNICATIONS INTERNATIONAL INC. AND QWEST CAPITAL FUNDING TO DISMISS CLAIMS FILED IN SHRINERS HOSPITALS FOR CHILDREN v. ARTHUR ANDERSEN & COMPANY, et al.

Qwest Communications International Inc. and Qwest Capital Funding (collectively "Qwest") request leave to file a Motion to Dismiss that exceeds the 15-page limit set forth in the Court's Practice Standards (REB Civ. Practice Standard V.A.1.). This relief is appropriate for the following reasons: 1. Plaintiff Shriners Hospitals For Children ("SHC") filed a 127-page

complaint. In order to fully and adequately respond to the complaint--in terms of both the complexity and abundance of issues--Qwest needs more than the 15 pages typically allowed. Qwest has endeavored to keep its motion brief and requests a total of 22 pages to address the allegations in Plaintiff's complaint.

2. complaint. 3.

Qwest's motion is a reasonable length, given the length of SHC'S

Undersigned counsel has conferred with counsel for the plaintiff, and

pursuant to D.C.Colo.L.R. 7.1., SHC does not oppose this motion. 4. Attached to this filing is a proposed Order granting Qwest's Motion,

pursuant to L. Civ. R. 7.1(F). WHEREFORE, Qwest respectfully requests that its Motion to Dismiss be accepted for filing. DATED: January 16, 2007 Respectfully submitted, __/s/ Alfred P. Levitt_______________ Jonathan D. Schiller David R. Boyd Alfred P.
