ORDER GRANTING DEFENDANT QWEST'S RENEWED UNOPPOSED MOTION TO CONSOLIDATE

This matter comes before the Court on Qwest Communications International Inc.'s ("Qwest") Renewed Unopposed Motion To Consolidate (Emergency/Forthwith Consideration Requested Pursuant to REB Civ. Practice Standard V.E.1) the action entitled Shriners Hospitals for Children v. Arthur Andersen & Company, et al., No. 06MSK-02189 (MEH) ("Shriners II") with Shriners Hospitals for Children v. Qwest Communications International Inc., et al., No. 04-CV-0781-REB-PAC ("Shriners I "). Upon consideration of the submissions of the parties and the relevant law, it is hereby ORDERED as follows: 1) That Qwest's motion to consolidate Shriners II for all pre-trial purposes with Shriners I is GRANTED;

2) That under FED R. CIV. P. 42(a), and D.C.COLO.LCivR 42.1, Shriners Hospitals for Children v. Arthur Andersen & Company, et al., No. 06-MSK-02189 (MEH), is CONSOLIDATED with Shriners Hospitals for Children v. Qwest Communications International Inc., et al., No. 04-CV-0781-REB-PAC for all pre-trial purposes; 3) That these consolidated actions shall be captioned as shown below;

Civil Case No. 04-CV-0781-REB-PAC (Consolidated with Civil Action No. 06-CV-2189) SHRINERS HOSPITALS FOR CHILDREN, a Colorado Corporation, Plaintiff, v. QWEST COMMUNICATIONS INTERNATIONAL INC., et al., Defendants.

And 4) That the hearing in Shriners II previously set for February 8, 2007 is CANCELLED.
