QWEST COMMUNICATIONS INTERNATIONAL INC., et al., Defendants. ______________________________________________________________________ UNOPPOSED MOTION FOR CLARIFICATION OF ORDER EXTENDING TIME AND SETTING A BRIEFING SCHEDULE ______________________________________________________________________ Defendants Qwest Communications International Inc. and Qwest Capital Funding, Inc. (collectively "Qwest") request that the Court clarify its Order Extending Time and Setting a Briefing Schedule.1 As good grounds therefore, Qwest states as follows: 1. Plaintiff filed its Complaint in Shriners Hospitals for Children v. Arthur

Andersen & Company, et al., No. 06-CV-02189-REB ("Shriners II") on October 31, 2006. Plaintiff served Qwest with the Shriners II Complaint on November 15, 2006.

Thereafter, Qwest sought consolidation of Shriners II with Shriners Hospitals for Children v. Qwest Communications International Inc., No. 04-CV-0781-REB-PAC ("Shriners I"). On December 6, 2006, the Court granted Qwest's Unopposed Motion to Consolidate (Docket No. 108). 2. On December 12, 2006, Qwest and Plaintiff jointly requested that the

Court enter an order requiring that Qwest and any other defendant who was served on or before December 15, 2006 be permitted to file an answer or motion to dismiss on or before January 15, 2007. 3. On the same day, the Court granted Qwest and Plaintiff's unopposed

motion for an extension of time, but ordered that defendants file answers or motions to dismiss "no later than thirty days after being served with a copy of that pleading[.]" Dec. 12, 2006 Minute Order, p. 1 (Docket No. 111). 4. Thirty days following the November 15 service of the Shriners II Complaint

on Qwest falls on December 15, 2006. 5. Qwest requests that the Court clarify its December 12, 2006 Minute Order,

and specify that Qwest's time to answer or move to dismiss be extended until January 15, 2006. Qwest submits that it needs this additional time to prepare its motion to dismiss in light of the efforts it previously spent moving to consolidate Shriners I with Shriners II. 6. Permitting Qwest until January 15, 2007 to file its motion to dismiss would

allow Qwest to coordinate its briefing with the briefing of any other defendant served by December 15, and would conserve resources. Qwest submits that such an extension

aids the efficient administration of justice and provides good cause to allow an extension of time. WHEREFORE, Qwest respectfully requests that this Court clarify its December 12, 2006 Minute Order and specify that Qwest shall file its motion to dismiss the Shriners II Complaint on or before January 15, 2007.
