JOINT STATUS REPORT

Plaintiffs Bank One, Colorado, N.A. and Bank One Trust Company, N.A. (collectively, "Plaintiffs"), and Defendants C.V.Y. Corporation, d/b/a Your Valet Cleaners, and Johnny on the Spot, Inc. (collectively, "Defendants"), respectfully submit this Joint Status Report. 1. In accordance with the Court' s orders, Plaintiffs, Defendants, and Defendants'

insurer have been engaged in ongoing mediation of this case. 2. On February 8, the parties held a full-day mediation session in Denver.

Significant progress toward a settlement of this case was made. 3. Although the parties remain optimistic that a negotiated settlement to resolve this

case can be achieved, settlement negotiations have not resulted in a resolution of the case, in part due to Defendants' desire to reach a global settlement of this matter, including the claims of the Cross-Plaintiffs. 4. Therefore, the parties believe that the case should be returned to the ordinary

litigation track, and that a new trial date should be set.
