THIS MATTER comes before the Court on Defendants CVY's and Johnny on the Spot's Unopposed Motion for Reconsideration of the Court's August 21, 2006 Order Granting Extension, Order # 447. Based upon the Court's review and consideration of the motion, IT IS ORDERED that:

(1) Defendants' motion is GRANTED. Order #447 is amended to provide that the parties shall contact the Court within seven (7) days following the October 17, 2006 mediation to advise the court of the need for trial and to set this matter for trial if necessary. (2) It is further ORDERED that, if trial is still necessary after the date the parties reconvene for mediation, that it be set as a five (5) week trial.
