JOINT STATUS REPORT

Plaintiffs Bank One, Colorado, N.A. and Bank One Trust Company, N.A. (collectively, "Plaintiffs"), and Defendants C.V.Y. Corporation, d/b/a Your Valet Cleaners, and Johnny on the Spot, Inc. (collectively, "Defendants"), respectfully submit this Joint Status Report to apprise the Court of the status of the mediation of this case. 1. In accordance with the Court's orders, Plaintiffs, Defendants, and Defendants'

insurer have been engaged in active and ongoing mediation of this case. 2. On October 5, 2006, the Court ordered that "[w]ithin 10 days after completion of

mediation" the parties submit a new pretrial order and advise the Court as to what issues remain to be tried. (Doc. # 450 at 3). 3. The mediation is not yet complete, but the parties believe that significant progress

had been made and that a negotiated settlement to resolve this case may be possible. 4. Therefore, unless otherwise directed by the Court, if the case has not been

resolved within 20 days, the parties will file another status report with the Court, informing it of the status or completion of the mediation, on or before November 20, 2006.
