Upon Defendant's motion, Government having no objection, and good cause appearing, the parties close to resolution of the case and requesting additional time to finalize the agreement before the need to file pretrial motions prior to the April 1, 2008 trial date, IT IS HEREBY ORDERED granting in part and denying in part [1244] Defendant's Motion to Stay and Extend Pretrial Motions Deadline. The Court denies the motion to stay but grants the motion to extend pretrial motions deadline. This court specifically finds that the ends of justice served by taking this action outweigh the best interest of the public and the defendant in a speedy trial. This finding is based on the court's conclusion that the failure to grant such a continuance would unreasonably deny the defendant continuity of counsel and would deny the attorney for the defendant the reasonable time necessary for effective preparation, taking account the exercise of due diligence. 18 U.S.C. § 3161(h)(8)(b)(IV). IT IS ORDERED extending the time to file pretrial motions to February 22, 2008. IT IS FURTHER ORDERED that excludable delay under Title 18 U.S.C. § 3161(h) will commence on 1/16/2008, for a total of 2 days. DATED this 16th day of January, 2008.
