UNITED STATES DISTRICT COURT DISTRICT OF ARIZONA UNITED STATES OF AMERICA, Plaintiff, vs. DANIEL SAMANIEGO-CACHON, Defendant. ) ) ) ) ) ) ) ) ) ) ) NO. CR03-1097-3-PHX-ROS
ORDER
Pursuant to Defendant's motion to continue, the Government not objecting, and good cause shown therein, as to Daniel Samaniego-Cachon: IT IS HEREBY ORDERED that the Defendant's motion to continue is granted in part and denied in part. IT IS FURTHER ORDERED resetting the status conference from July 24, 2007, to August 27, 2007, at 1:30 p.m. IT IS FURTHER ORDERED resetting the trial date of August 7, 2007, to October 2, 2007, at 8:30 a.m. This Court specifically finds that the ends of justice served by granting a continuance outweigh the best interests of the public and the Defendant in a speedy trial. This finding is based upon the Court's conclusion that the failure to grant such a continuance would deny the Defendant the reasonable time necessary for effective preparation, taking into account the exercise of due diligence. 18 USC §3161(h)(8)(B)(iv). IT IS FURTHER ORDERED denying the motion for extension of time to file motions. Counsel may re-urge the motion at the status conference.
