ORDER
Pursuant to Defendant's oral motion to continue, the Government not objecting, and

good cause shown thereto,

IT IS HEREBY ORDERED that the Defendant's motion to continue is granted

pursuant to 18 USC §3161(h)(8)(A) and the trial date of November 7, 2006, in this matter
17
is continued to March 6, 2007, at 8:30 a.m.

This Court specifically finds that the ends of justice served by granting a continuance
19
outweigh the best interests of the public and the Defendant in a speedy trial. This finding is
20
based upon the Court's conclusion that the failure to grant such a continuance would deny
21
the Defendant the reasonable time necessary for effective preparation, taking into account
22
the exercise of due diligence. 18 USC §3161(h)(8)(B)(iv).

EXCLUDABLE DELAY pursuant to 18 U.S.C. §3161(h)

is found to
commence on 10/16/06 for a period of 141 days.
