The Government filed a Motion pursuant to F.R.Crim.P. Rule 15 to depose Larry Carr, who resides in Tampa, Florida. The trial is currently set for April 4, 2006. Defendant objects to the Motion, arguing that the possible use of the deposition at trial violates Defendant's rights under the Sixth Amendment to the U.S. Constitution. The Motion and objections were heard March 6, 2006, with Mr. Carr present by telephone. treatments of prostate cancer.
