The Government filed a Motion pursuant to F.R.Crim.P. Rule 15 to depose Larry Carr, who resides in Tampa, Florida. The trial is currently set for April 4, 2006. Defendant objects to the Motion, arguing that the possible use of the deposition at trial violates Defendant's rights under the Sixth Amendment to the U.S. Constitution. Accordingly, IT IS ORDERED that the videotaped deposition of Ralph Carr be taken in Tampa, Florida during the week of March 20, 2006, at a place and time agreeable to counsel or if there is no agreement, to be set by the Court after further expedited hearing. DATED this 6th day of March, 2006.
